A Northern California woman charged with having intimate relations with her estranged teenage son and filming the incestuous sex with the boy’s cell phone video camera has struck a plea bargain with prosecutors.
The Napa Valley Register reports that 32-year-old Mistie Atkinson of Nice, Lake County, pleaded no contest to incest charges Tuesday in Napa County Superior Court. Atkinson was also charged with oral copulation with a minor, lewd contact with a minor and distributing lewd materials to a minor.
By pleading no contest, Atkinson neither admits or denies any wrongdoing. But the consequences of her plea are similar to as if she had pleaded guilty; she could face up to four years and eight months behind bars.
The Napa Valley Register reported in April that Atkinson was arrested on a warrant in a Ukiah, Calif., hotel room in March, where police found her with the boy.
Videos dated Feb. 3 and 4 showed the woman engaging in sexual intercourse with her son; she is also accused of sending nude photos of herself to the boy electronically.
A law enforcement source told the New York Daily News that the pair had been separated for 15 years and that she tracked him down through Facebook. She then began “sexting” him, sending him explicit messages and arranging a reunion.
“Atkinson and the victim are aware they are biological mother and son,” the police complaint against her states.
After contacting the boy, she “had been talking to him in manner that no mother should talk to their son,” according to court documents.
“She started to have a boyfriend-girlfriend relationship with him, not a mother-and-son relationship,” the teen’s father claimed in a court document. “It got to a point where their conversation began talking about harming me and killing off her boyfriend she was (now) living with. She was sending him pictures of her body and basically seducing him. The relationship needs to stop and we told both of them but they continue to get in contact with each other. It’s unhealthy and they need to stay apart,” he added.
The incestuous pair also allegedly discussed running away together. The boy’s father, who learned about the relationship in December, filed a restraining order against Atkinson. He has full custody of the teen.
The Daily News reports that Atkinson has a history of domestic violence calls with police in Nice, where she lived with her boyfriend. She was arrested for domestic battery last Nov. 27.
“That appears to be the start of her spiral,” the law enforcement source told the Daily News.
