COMMENTARY | President Obama has issued yet another in a long line of imperial fiats which he has no constitutional authority to implement.
This time around, Obama has unilaterally decreed provisions of the “Dream Act,” in direct violation of his constitutional powers to do so. Worse yet, he knows he doesn’t have this power.
In 2011, Obama said of the “Dream Act” which failed overwhelmingly, “This notion that somehow I can just change the laws unilaterally is not true. The fact of the matter is there are laws on the books I have to enforce. And there is a great disservice done to the cause of getting the DREAM Act passed and comprehensive immigration reform passed by perpetuating the notion that somehow by myself I can just go and do these things,” as reported by Politico.
In a separate matter, he also advised that we live in a democracy. How does anyone, let alone a card carrying socialist (Newsbusters) become president when he doesn’t even know what kind of nation he is president of?
A democracy, or majority rule, is 2 birds and a worm deciding what’s for dinner or 2 armed thugs and a millionaire deciding who gets the money, but I digress.
Rep. Steve King (R-IA) advised on Friday’s Mike Huckabee Show that he will bring a lawsuit against the administration to keep Obama from implementing what will essentially become an amnesty program for illegal aliens, and ultimately their families once the children get in, as reported by the Daily Caller.
King advised he has experience in this area as he has previously sued former Iowa Governor Tom Vilsack for illegally using executive orders in place of legislation.
Of course, Obama isn’t the only president to abuse executive orders, Bush did it, Kennedy did it and everyone in between, but this does not negate the fact that it is unconstitutional nor the fact that granting citizenship to the millions of illegals will not only break the back of what’s left of our economy, but is a slap in the face of all who came here legally and had to work for what Obama and the democrats wish to give criminals for free.
This matter should be long since settled.
In Youngstown Sheet & Tube v Sawyer, Justice Hugo Black (a Democrat) wrote, “The President’s power, if any, to issue the order must stem either from an act of Congress or from the Constitution itself.” Obama has neither.
These “children” also have no birth right to citizenship, even if they were born here.
In United States v Wong Kim Ark, Justice Horace Gray opined that Ark, a child of Chinese citizens born in San Francisco, was only a citizen because his parents were here legally, engaged in legal business and had already established a domicile in the United States at the time of his birth. An illegal alien, by definition, have none of these qualities.
